Mesothelioma Lawyers and Mesothelioma Compensation

As a result of asbestos manufacturers' negligence thousands of innocent people die every year. If you are one of the victims or someone you know you should contact a mesothelioma lawyer as soon as possible.

Nobody can help you in your suffering but you do have your legal rights and you should go after those who have hurt you. Engaging a lawyer with broad familiarity and knowledge of asbestos claims can assist you in obtaining reimbursement from those responsible.

In 1920s asbestos companies knew that their product not only endanger human health, but also that it was the foundation to claim the lives of those exposed to the material.

As early as 1930s and '40s, medical facts had undoubtedly connected asbestos exposure to lung illnesses and fatal asbestos cancers. In spite of the widespread warnings of these dangers, asbestos companies in place of selecting to make use of optional material (many were available at the time), they decided to choose soaring income over the protection of human life.

As you can see these people because of their unethical behaviour deserved to be held accountable for the suffering of the innocent people dealing with deadly diseases. You have legal options for the reason of these criminal activities and are allowed to search for compensation through the court system.

Your legal rights let you file a claim against the company liable for your asbestos contact this will not only convey justice to the dishonest asbestos industry, it will also give you the chance to be rewarded for the costs, as well as hurt and misery, associated with asbestos-induced sicknesses. Below you can find some of the expenses for which you can expect compensation:

Lost wages

Medical bills

Funeral expenses

Expenses not covered by health insurance

Group support for you and your your family

Travel expenses relating to medical treatments

Lawyers specialising in mesothelioma related cases can re-evaluate even more expenses that could be covered under your lawsuit, since each case is different. You should take care of all medical and financial paperwork related to your asbestos-induced illnesses for this reason.

After providing all the necessary papers and responding questions about your state and how you may have been exposed to asbestos, you will not be needed with the other phase of the course of action. It would be unwise to force you to deal with the details of the case or attending trial. For this reason, mesothelioma lawyers -- handle all the details of the procedure.

You may be eligible to file the legal claim in one of the two form of lawsuit:

A wrongful death suit - in case if a family member has passed away from an asbestos-related disease. A personal injury claim - must be filed by the person suffering from asbestos-induced illnesses. The lawsuit may be filed when an asbestos-related sickness has been detected, even if your first contact with asbestos were many years or even decades ago. In this case the law identifies that asbestos can have an effect on the body in excess of many years. But keep in mind that you must file suit within the state's mandated time period. This is very important because if you wait, you may lose your rights against the company accountable for your asbestos exposure.

Another very important fact is that not only employees of companies who used asbestos are the persons who have rights against asbestos companies. While most of cases are between employers and employees, other groups have rights too.

For example, asbestos easily sticks to cloths and hair making it a quite simple to bring it home after having been in contact with the material. In this case if you have developed an asbestos-related sickness for the reason that a spouse or family member worked using asbestos, you may also have a case.

Mesothelioma Law Is There to Entitle the Patient His Legal Rights

Whenever in any turn of life or profession, man is deprived of his rights or his rightful demand, then in all civilized countries and societies in the world there is specific law to take resort to. The law is the only medium for enforcing the right of the deprived. It is no exception in case of mesothelioma patients. There is mesothelioma law to enforce his legal right. In human body different organs are covered with a thin semi-transparent layer, which medically is termed as mesothelioma. Due to prolong exposure to dust particles this mesothelium gets affected with infections often leading to malignant carcinoma. In simple term, mesothelioma is the cancer of mesothelium. In industries which involve large amount of dust emission as part of the production process are bound to provide their workers with protective equipments and outfits, under mesothelioma law.

In many industries where dust emission is part of the production process, the workers are either provided with poor standard dust-preventing outfits or no outfits at all. Gradually, they remain exposed to the hazard of dust, and adapt lungs diseases due to inhaling dusty air. Such diseases often reach to cancer of mesothelium layer surrounding the lungs. Unfortunately, at this stage the worker becomes useless to the company as he could no longer continue with heavy work due to weak heart. If he demands any compensation from the company for such a painful life, the demand is simply turned down, leaving him nowhere.

In such situation the mesothelioma lawyer becomes immensely helpful to entitle the affected worker with some rightful compensation. Mesothelioma lawyer decides the merit of the case, studies the entire history of dust exposure of the affected worker and takes appropriate legal steps to claim compensation. Often mesothelioma lawyer may engage private investigator to find the history and level of dust exposure alleged by the affected worker. But, in the entire process, mesothelioma law allows the worker not to pay a single penny to the mesothelioma lawyer, until he is awarded the compensation. In case, even after taking all toil and hardship by the mesothelioma lawyer, the case is lost, then the mesothelioma law permits the affected worker not pay a single penny. Actually, in normal practice, the fee is charged by the mesothelioma lawyer as a percentage from the compensation amount. Naturally, when there is no compensation there is also no question of paying fees. As there is a time of limitation in filing the suit, so it is always wise to find a mesothelioma lawyer before the it is too late and thus time-barred to file the case.

As seen in human history of civilization for many times in any developed country, the laws play an important role in holding the integrity and rights of its people together, mesothelioma law does the same thing making itself a tool for giving justice to all those who are affected, suffering, left impoverished and at the mercy of the fate. This mesothelioma law thus allows the worker, with the help of lawyer to claim the rightful demand.

Mesothelioma Lawyer - Asbestos Attorney - Mesothelioma Lawsuits & Lung Cancer Information

Mesothelioma is one of the most tragic diseases ever to strike the working man. Due to decades of manipulation, denial, cover-ups, and outright falsehoods by the asbestos industry, thousands of people and their families across the country have had to face the tragedy and heartbreak of mesothelioma.

Asbestos is a fibrous, naturally occurring mineral that has been used for millennia as insulation and fire protection, but it was noted in ancient times that the slaves and workers forced to deal with it usually lived much shorter lives and died of respiratory diseases. 2000 years later, the asbestos industry mechanized the ability to produce this deadly material on a wide scale, and millions of American homes, schools, churches, and offices were filled with this dangerous and deadly material.

Mesothelioma is a type of cancer that affects the mesothelium, the lining that covers major organs that secretes mucous that allows them to move and function. After people inhale or ingest microscopic yet jagged asbestos fibers, these fibers pierce through the lungs, stomach/intestines, or heart and begin to develop tumors. These tumors take decades to develop, which means by the time they have any symptoms it is too late to treat the disease. Once the mesothelium becomes cancerous, it is usually too late to save the organs it affects, and thus most people die within one and five years after mesothelioma is discovered.

Part of the tragedy of mesothelioma is that the asbestos companies allegedly covered up the dangers of their product, intentionally deceiving their employees because they did not want to expose themselves to public rebuke and governmental investigation.

The affects of this nationwide exposure to asbestos are now being felt in the people that must cope with a terminal mesothelioma diagnosis. Unfortunately asbestos was not only used in homes and other structures, but other asbestos-containing products include:

o Zolonite

o Bendix brake pads

o Raymark brake pads

o Floor tiles

o Clutch plates

o Plaster

o Concrete

o Fire doors

Mesothelioma, and its related disease asbestosis, are terminal diseases. There are no cures for the disease, and doctors can only help ease the pain and suffering of people that must endure this disease. Current cancer treatments such as chemotherapy, surgery, and radiation have had limited effect with mesothelioma, but new avenues of therapy include:

o Alimta

o Cisplatin

o Onconase

o Veglin

o Tomudex

o Vinorelbine

The fact about mesothelioma is that it is one of the deadliest occupational diseases in the United States. Although there are a number of mesothelioma support groups and clinical trials, a cure is out of current medical reach.

Finding the Right Mesothelioma Attorney?

In order to get compensation for mesothelioma, filing a
lawsuit is quite imperative. However the process is quite
long drawn and tedious. The most important step pertaining
to the same is selecting the correct mesothelioma attorney
or law firm.

It is important to find a good, decent and
experienced mesothelioma lawyer as soon as possible after
one has been diagnosed with the disease. In most places
there is a set time limit within which one can file a
lawsuit, and it is very important that the victim party does
not miss that deadline. Otherwise it may land you up as an
ineligible claimant. So, the earlier you get to a
mesothelioma lawyer, the better are your chances of success.

Apart from that the firm should be trustworthy one and the
victim party should build up an excellent relationship cum
rapport with the same. If one is considering about filing a
mesothelioma lawsuit, then the victim party should meet up
with several law firms before making the final decision.
There are a large number of law firms who are specialized in
filing mesothelioma lawsuits.

In order to choose the correct law firm for filing your
lawsuit, the following steps can be followed:
o Start the Search: You can look for a qualified
mesothelioma attorney in various bar associations,
Martindale-Hubbell Law Directory that is found in most
public libraries, Yellow Pages, and of course the Internet.
Law firms normally have their own sites.

o Narrow down the Field: After compiling a list of some
mesothelioma law firms in your area, try to make establish
contact with them either by mail, email or telephone for
further information. It is important to provide the law
firms with details of your legal issue and find out if they
can handle your situation.

Also enquire about their fees for an initial consultation
and an estimate of the total costs involved in handling a
mesotheliomalawsuit. It is recommended that the victim party make
schedule appointments with two or three different law firms before
coming to the final decision.

o Meet the Prospective Attorneys: During the initial
consultation, it is important that you and your lawyer get
to know each other. There has to be a free flow of exchange
words between both of you. After carefully reviewing your
case, the lawyer must be in a position to inform you of your
rights and suggest alternative courses of action, if any.

Moreover, it is during this initial consultation period that
a mesothelioma attorney can explain what he or she can do
for you and how much will be the cost factor. Also it is
important for you to know about the attorney's experience in
handling previous mesothelioma lawsuits. If you are totally
satisfied with the details, you may request a written fee
agreement before proceeding and a list of references that
you may contact.

Making your Decision: After each initial consultation, it is
important to consider the following questions about the
mesothelioma attorney you just met:

o Did I got a firm understanding of my alternative courses
of action from the attorney?

o Was the attorney knowledgeable about asbestos law?

o Was I given enough time and did the person listened to me
carefully?
o Did the attorney seem trustworthy?

o Am I understanding the range of possible results, which
might spill out during each course of action?

Fees: It is important to consider this aspect with due
diligence. To lower costs, you can ask your asbestos lawyer
to employ a junior lawyer to perform a certain part of the
entire process. You can also do some tasks by yourself to
save time and money (Provided your attorney allows you to do
the same). An asbestos lawyer may charge a flat fee for a
specific task or offer other methods of payment.

Also you can go for contingent fee arrangement process. A
contingent fee arrangement is that your lawyer gets a
percentage of the compensation money you receive as
resolution of your asbestos lawsuit. If you do not receive
compensation for the lawsuit then your lawyer collects no
fees. A contingency fee is a good option for those people
who cannot do away with hourly legal fees.

Also you may incur charges on other fronts like; court fees,
copying, hiring expert witnesses etc.

Mesothelioma lawsuit records:
Keep copies of all the documents that you hand over to your
lawyer relating to your lawsuit.

How to Find and Choose a Lawyer to Fight Your Mesothelioma Case

There are over $600 Million dollars for Federal Recoveries nationwide in the USA, that means all the mesothelioma lawyers want a mesothelioma patient and have a piece of the $600 million dollar. Deciding to file a lawsuit is a very big step for most of the mesothelioma patients, Most of the mesothelioma patient do not consult a lawyer to win their rights from the law and are afraid of the high costs of the juries if they ever lose a trial. The other difficult part is deciding a lawyer to fight your case, most of the lawyers think more about their own profit then their patients.

If you are diagnosed with mesothelioma and want to appeal for your damages, you have to consult a lawyer and have all the proof you need to win the case. Ask your friends, search the internet or look at your directory for a lawyer who you can be happy with and is easy to talk to, a lawyer with too much experience will often rip their clients and are experienced in benefiting more for themselves then the client. Choose a lawyer that you can trust and or have known for some time. Do not ever put a ad or contact a law firm about your need of a lawyer, you will be annoyed by the amount of calls you will get trying to get you as a customer and you might make a mistake by choosing the wrong person. When you choose a lawyer that you can trust and you feel good with then you can go ahead to your next step and find all the information about your past that you can. Find a old friend from your old workplace, where you got the disease from. Contact your manager, your old company and inform them about your situation.

Make sure you have all the medical reports and results you need to proof that you are diagnosed with mesothelioma. Keep in touch with your doctor once in a while, because you might need him in the jury and always keep two copies of your medical documents for the court. Make sure the dates and signatures in your documents are Accurate, because even a small mistake could go against you. Contact as many mesothelioma specialists as you can as a backup for your case, in case you needed more people to proof your disease.

On the jury day, Make sure you arrive at your trial early and have your family and friends with you to support you. Support is the most important factor in a trial or you will feel nervous and make mistakes during your case. Always listen carefully to what the judge and other lawyers are saying. NEVER say yes/no to a question until you understand it carefully. Think about 10 seconds before answering any questions.

Some of the points that you have to proof in your Mesothelioma case are:
The Fact: You have to prove you got the disease from your work or it some how made its way to your home. You have to prove you were never told about this during your work. You were not educated about Mesothelioma prevention before or during your job. Mesothelioma is a term you never heard before. You have Medical papers proving you are diagnosed with Mesothelioma. You did not take any medication or lived near a industrial area or worked in a location where asbestos was exposed to the breathing air. You can provide accurate information of your relationship with your employer from the term you started working there until you quit for what ever reason.
Most of the mesothelioma cases are won in a federal trial, if the person has proof of the mesothelioma diseases inside his body; so most of the mesothelioma patients have been successful in last few years. It's your right, so take the step.

Best Treatment Options for Mesothelioma

Finding the Best Solutions for this Tricky Cancer

When you are dealing with Mesothelioma, you don't have a lot of different options for treatment in most cases. The way that this condition presents, combined with its known latency period that can last between 4 and 5 decades, makes it very difficult to treat effectively. Patients can experience many types of this condition, and while 75% of cases present in the lungs, it can also be diagnosed in the abdomen or heart. Finding the right treatment is all about understanding the type of Mesothelioma that is present, its stage of development, and where it is located in the body.

Avoid Misdiagnosis

This is a very uncommon cancer in the grand scheme of things. Therefore, it often goes undiagnosed for a long time, or it is misdiagnosed because the odds of actually having it are so rare. Once a suspected diagnosis of Mesothelioma is present, the doctor will order tests to figure out exactly what is going on. Make sure that if you have had exposure to asbestos in your lifetime and you present with common symptoms, you note this so that you have a better chance of getting the right diagnosis for more effective treatment options.

The Prognosis

Mesothelioma doesn't have a particularly good outlook for patients who are suffering from the condition. There are plenty of elements that affect your survival rate and initial prognosis, including things like:

-The size and stage of the cancer

-Whether surgery is an option

-The type of Mesothelioma that is diagnosed

-The age and health of the patient

-Initial diagnosis vs. a secondary case after treatment and remission

Treatment Solutions

There are many different treatment options for this condition, depending on various factors like those mentioned previously. In most cases, radiation, chemotherapy, and surgery are the standard treatment options. Of course, this cancer usually requires an aggressive combination treatment for the best possible results.

Surgery:

There are four types of surgery that are used to treat Mesothelioma. An excision will remove the cancer and some of the healthy tissue to make sure that the cancer is completely gone. This is effective, but rarely an option because the cancer has spread too far by the time of diagnosis. Pluerectomy and decortication, which is a procedure that removes the lining of the lungs and other areas that are affected, is another option. In some cases, doctors will remove an entire lung, as well as parts of the diaphragm and the lining of the pericardium, which protects the heart. The final procedure involves using chemicals and drugs to create scarring in the lung lining. That stops the buildup of fluid in this disease.

Radiation Therapy:

Like most cancers, Mesothelioma can be treated using radiation in many cases. This helps kill the cancer cells, but can cause a lot of side effects that are less than desirable. Because of the advanced stage that is usually present at diagnosis, most people require aggressive radiation therapy combined with medications or surgery to get the best treatment possible.

Medications:

Chemotherapy, which is administered orally or by injection, is effective at stopping the cells from growing and spreading. This treatment can be done with pills, IV treatments, or intramuscular injections, which will help ensure that the cells are killed or stopped in the right area. In many cases, combination chemotherapy is employed because multiple drugs have a better chance of killing the disease than a single drug alone

Choosing the Right Treatment

It starts by talking to your doctor and developing a treatment plan. The type of Mesothelioma that you have, combined with other factors, will determine the right solution for your best prognosis.

Malignant Mesothelioma - A Dreaded Disease

Malignant mesothelioma is cancer that starts in the cells that line most organs of the body, especially the chest, belly, and heart. The lining formed by these cells is called mesothelium. The mesothelium forms a protective sac that surrounds internal organs of the body. It consists of two layers: one layer of cells surrounding the organ and another forming a sac around it. These cells secrete a fluid that allows organs to move effortlessly and harmlessly within the space defined by the mesothelium.

Thus, moving organs like the heart and the lungs can function normally only with a functioning mesothelium. Mesothelioma is a disease in which the cells of the mesothelium become abnormal and multiply uncontrollably, invading the surrounding tissues affecting the very organs they are supposed to protect. In most cases of mesothelioma, the lungs are the organs that are affected. The mesothelium of the lungs is known as the pleura. Pleural mesothelioma is the most commonly diagnosed form of the disease.

Risk factors and risk groups

Mesothelioma is associated with asbestos. Around 70-80% of all cases of mesothelioma have a history of exposure to asbestos. Asbestos is a group of minerals that has been widely used in industrial products such as cement, brake linings, flooring's, textiles and insulation. The first cases of mesothelioma occurred in the 1900s in Britain where workers at asbestos factories began experiencing a high level of lung disease. The disease was then referred to as asbestosis. It was only much later, in 1959, that the link between asbestos and lung cancer was made.

Mesothelioma can also arise as a result of secondary exposure to asbestos. A chance of developing cancer in families and other persons in contact with asbestos workers is great due to exposure to dust from the clothing and hair of the worker. People living in old buildings (prior to banning of asbestos in construction materials) are also at risk. The occupations that are most associated with mesothelioma include: construction industry workers, electricians, plumbers, shipyard workers, textile workers etc.

Incidence of mesothelioma

Most countries now specify the level of asbestos that can be safely present in the working environment of a person. Since the risk of asbestos-related disease increases due to heavy and longer exposure to asbestos, proper working environment led to a reduction in the cases of mesothelioma. Mesothelioma is now a relatively rare disease; only 2000 cases arise every year in the United States.

Living with the disease

Like many other cancers, there is very little one can do where the diagnosis has not been made in the early stages of the disease. Unfortunately, most cases of mesothelioma are diagnosed in its late stages. There is no cure for the disease. In some cases, tumors may be removed by surgery, in the hope that it has not already spread to other parts of the body. Surgery may aim to remove the tumor or the entire lung. Treatments by radiation and chemotherapy are mostly palliative (i.e. aiming to reduce the severity of symptoms rather than treating the disease).

How to address a Mesothelioma lawyer

An individual is exposed to asbestos fibre and is diagnosed with mesothelioma cancer may file a complaint about the problem.

The lawyer will help you in the preparation of the required forms to fill out to submit your case in Cour.De this way you can collect compensation for health damage. The beauty to engage lawyers of mesothelioma is that most of them does not collect payment until what receive you compensation.Their task is to obtain a monetary compensation for clients, to enable them to concentrate on the fight against mesothelioma without the stress of financial worries. You can acquire adequate compensation that can help you to cover all legal, medical, but also current, while the Court of first instance is happening.

Why is this the case?

The fact is that most mesothelioma cases could have been avoided if information that was known and available to the asbestos companies had been passed along the employees of asbestos products.

The prosecution will be asist all victims by offering all the benefits they need. Further benefits to the persons who received a diagnosis, but also the people who were exposed to the substance. The company involved in the trial is required to compensate their past and current employees. It is because they do not have to disclose the risk involved on asbestos.

How to detect early symptoms of mesothelioma?

There is virtually not the first symptoms of mesothelioma, this is why the disease is usually diagnosed at an advanced stage of development. Those who are exposed to asbestos, but have not yet exposed symptoms must undergo regular chest x-rays or tests of pulmonary function of monitoring the adverse effects of the inhalation of asbestos.

New Developments in Mesothelioma Research and Treatments

Cancer research and development is an ongoing process. In the field of mesothelioma treatment, researchers are focusing on improving traditional treatments as well as developing new techniques to ease the pain of patients. New chemotherapy agents and combination's are now giving new hope to mesothelioma patients and are increasing the survival rate amongst them. Several recent advances have improved diagnosis and treatment of this incurable disease. Hoping for a cure in the near future is therefore not something surreal.

CT Scans

Computer tomography scans are not only a diagnostic tool in mesothelioma treatment. CT Scans now enable the surgical team to accurately determine the position of tumors in the anatomy of the patient. This enables cytoreduction to be more effective. Adequate cytoreduction is an essential prerequisite to improving the survival chances of the patient. The greater the number of tumor cells that are removed, the less is the chances that the cancer grows and propagates.

Photodynamic Therapy (PDT)

Photodynamic Therapy is one of the latest mesothelioma treatments being researched. PDT makes use of a photosensitizer. This is a drug that produces active oxygen when exposed to a certain wavelength of light. Active oxygen destroys all nearby cells. When the patient is treated with the photosensitizer (e.g. with porfimer sodium), the drug invades the whole body. However, by the very nature of the molecule, it remains attached to cancer cells for a longer period. Hence, after a period of 24-72 hours, when the agent has been removed from the normal cells, the tumor is exposed to light (usually a laser transmitted to the tissue by a fiber optic cable carried by an endoscope). Active oxygen destroys the tumor cells directly with minimal damage to normal cells. PDT also helps to shrink tumors indirectly by destroying the blood vessels that supply tumors and activating the immune system to fight the tumor.

The advantage of PDT is that it can be used repetitively with much less side effects than other treatments. The main drawback is that the light usually cannot reach tumor cells that are more than 1 cm deep. Hence, PDT is most effective in skin cancers and cancers found in the lining of internal organs or cavities. Fortunately, mesothelioma falls in this category.

Angiogenesis Inhibitors

Angiogenesis refers to the development of new blood vessels. Blood vessels are a critical factor in the growth of tumors. All malignant tumors develop their own vascular system that carries nutrients from the bloodstream to the tumor, fuelling its growth. Controlling the development of these vascular systems has been an important strategy in the fight against mesothelioma cancer. Angiogenesis inhibitors are drugs that block angiogenesis. This cuts off the supply of oxygen and nutrients to the tumor whose growth immediately halts.

The advantage of angiogenesis inhibitors is that they are not as toxic as most other chemotherapy drugs. They can thus be given continuously to the patient and are thus more effective in fighting the cancer. An example of an anti-angiogenesis drug under clinical trial for mesothelioma is bevacizumab (Avastin).

Malignant Mesothelioma

Malignant mesothelioma is an uncommon, but no longer rare, cancer that is difficult to diagnose and poorly responsive to therapy. Malignant mesothelioma is the most serious of all asbestos-related diseases.

A layer of specialized cells called mesothelial cells lines the chest cavity, abdominal cavity, and the cavity around the heart. These cells also cover the outer surface of most internal organs. The tissue formed by these cells is called mesothelium.

The mesothelium helps protect the organs by producing a special lubricating fluid that allows organs to move around. For example, this fluid makes it easier for the lungs to move inside the chest during breathing. The mesothelium of the chest is called the pleura and the mesothelium of the abdomen is known as the peritoneum. The mesothelium of the pericardial cavity (the "sac-like" space around the heart) is called the pericardium.

Tumors of the mesothelium can be benign (noncancerous) or malignant (cancerous). A malignant tumor of the mesothelium is called a malignant mesothelioma. Because most mesothelial tumors are cancerous, malignant mesothelioma is often simply called mesothelioma.

Mesothelioma was recognized as a tumor of the pleura, peritoneum and pericardium in the late 1700's. However it was not until much later, in 1960, that this particular type of tumor was described in more detail and even more importantly, its association with asbestos exposure was recognized. The first report linking mesothelioma to asbestos exposure was written by J.C.Wagner, and described 32 cases of workers in the "Asbestos Hills" in South Africa. Since than the relationship between mesothelioma and asbestos exposure has been confirmed in studies around the world.

The incidence of mesothelioma in the United States remains very low, with 14 cases occurring per million people per year. Despite these numbers the noticed threefold increase in mesothelioma in males between 1970 and 1984, is directly associated with environmental and occupational exposure to asbestos, mostly in areas of asbestos product plants and shipbuilding facilities.

Although the disease is much more commonly seen in 60-year old men, it has been described in women and early childhood as well. The cause of the disease is not so well understood in these latter two groups, but there is some evidence of possible asbestos exposure for some of these cases as well.

Mesothelioma is one of the deadliest diseases known to man; the average life span of an inflicted person from the time of diagnosis until death is less than 24 months. It's a disease that strikes approximately 3,000 United States citizens each and every year; hard working people who have labored for a lifetime to provide for their families, doing the work that keeps this country running and a great place to live. They worked in factories, at shipyards, in mines, for the US military, as engineers, as pipefitters, as steel workers, as auto mechanics, and in so many other professions. They came home to their loved ones exhausted and covered in dirt and dust; tired, but content that they had a job and were providing for their family. Content that they were putting food on the table and a house over their loved one's heads. Content that they were working to make a better life for their families in this generation and the next...

But what they didn't know was that while they were working so hard, they were not only slowly killing themselves, but those that they were working so hard to help; their family, their loved ones.

What is the mesothelium?

The mesothelium is a membrane that covers and protects most of the internal organs of the body. It is composed of two layers of cells: One layer immediately surrounds the organ; the other forms a sac around it. The mesothelium produces a lubricating fluid that is released between these layers, allowing moving organs (such as the beating heart and the expanding and contracting lungs) to glide easily against adjacent structures.

The mesothelium has different names, depending on its location in the body. The peritoneum is the mesothelial tissue that covers most of the organs in the abdominal cavity. The pleura is the membrane that surrounds the lungs and lines the wall of the chest cavity. The pericardium covers and protects the heart. The mesothelial tissue surrounding the male internal reproductive organs is called the tunica vaginalis testis. The tunica serosa uteri covers the internal reproductive organs in women.

What Is My Diagnosis?
There are three types of mesothelioma. Pleural mesothelioma is a cancer of the lining of the lung (pleura), peritoneal mesothelioma is a cancer of the lining of the abdominal cavity (peritoneum), and pericardial mesothelioma is a cancer of the lining surrounding the heart (pericardium). Sub-types (or cell types) of mesothelioma are epithelioid (the most common, and considered the most amenable to treatment), sarcomatous (a much more aggressive form), and biphasic or mixed (a combination of both of the other cell types).

The structural appearance of cells under the microscope determine the cell or sub-type of mesothelioma. Epithelioid is the least aggressive; sarcomatoid, the most aggressive. The biphasic or mixed cell type shows structural elements of both of the other two.

Mesothelioma - Asbestos Poisoning and Mesothelioma Lawyer FAQ's

If you or anyone you know have been exposed to such things as hazardous materials containing asbestos you may want to get checked out by a physician. Asbestos poisoning can lead to a cancer known as mesothelioma. There are several different types of mesothelioma as well including;

Malignant pleural mesothelioma -This type is a malignant cancer of the lungs, which is the most common type of the disease seen in patients suffering due to the inhalation of the asbestos fibers. This can be caused by working in such hazardous occupations as welding and fabrication plants, various types of construction, and many other industrial occuptions handling hazardous scrap materials. Pleural mesothelioma is most commonly apparent before other forms of the cancer, as the lungs are the first organ exposed to the asbestos. Malignant pleural mesothelioma is the most common as opposed to just pleural mesothelioma as the exposure rate of the lungs is higher than other organs, and cancerous growth is more eminent.

Peritoneal mesothelioma is a type of cancer that affects mesothelium lining of the abdomen, and is due to exposure of asbestos dust. Most cases seen are in some way pleural affecting the lungs as the asbestos fibers must be inhaled through the airways in order to enter the body in the first place. That's why you also may see cases in which the patient has both pleural and peritoneal mesothelioma. The mesothelium lining which lines the body's internal organs is a protective tissue lining in which malignant cells develop in.

Pericardial mesothelioma is cancer of the heart in which the mesothelium of the heart is affected with malignant cancer cell growth. This can be an especially dangerous form of the cancer as it can impair the function of the heart through affective disorder of the protective heart lining or mesothelium of the heart. In cases where tumor growth is present it is especially dangerous of the pericardium. The pericardial lining is present inside the ribs or pleura and in or around the abdominal organs which is the peritoneum. Unfortunately, by the time this disease is diagnosed it is almost always fatal. Because of the rate of use in asbestos type materials several decades ago there has been seen an influx of mesothelioma cases due to the incubation rate of the disease in patients suffering from this type of cancer. It is important that if you even think you may have been subject to exposure of asbestos of any kind including that of old paint or old building materials you get checked out immediately even if no symptoms are present. It's unfortunate that symptoms cannot be used as an indicator for the disease due to the high fatality rate.

If you have been exposed to such materials or even think you may have it is also suggested that you seek the aid of a mesothelioma lawyer who can help make you aware of your rights, and to the fault of the exposure. This can help take a load off on the costs of getting tests run and initiating treatment to help treat the disease before the onset of symptoms occur. They can make you aware of your rights, and what you can do in such a case. They are equipped with many resources to help you find the best physicians and treatments as well.

There are also many mesothelioma attorneys who are now assigned to cases of asbestos poisening who act on behalf of both the affected and the defendant as well. There are several class action mesothelioma lawsuits against asbestos exposure due to the unlawful intent of several companies operating in such unsafe condition; as to make their workers in danger of asbestos poising leading up to mesothelioma disorder. If you think you may have rights to such a mesothelioma lawsuit an attorney can help determine if you qualify, and aide you in getting the process started. They are a good resource and starting point when you become aware that you have been affected by asbestos in your life.

Mesothelioma Survival Rate - Bad!

Mesothelioma Survival Rate is not high and on average people diagnosed live from 4 to 11 months after. This survival rate is just harsh reality and devastating to the patients and their families. Sad is this fact as well that there are around 3,000 new diagnoses a year. However, new experimental treatments are being worked on to increase that number. See, this is good news because you get to spend that much more time with your loved ones. The American Cancer Society has been quoted to say that 40% of the patients now diagnosed with mesothelioma not live longer than a year and an average 10% live longer than 5 years.

The estimating or predicting, or attempt to do so, for anyone is difficult and there are some factors to take into consideration. Plus, the fact that no two patients are alike and what is true for one is not for another. The first factor that affects the individual's mesothelioma survival rate is the latency period.

The latency period is a big factor in the mesothelioma survival rate. This period is the amount of time from the time of exposure to asbestos and the first symptoms of mesothelioma. The time span between the two, or latency period, is anywhere from 20 - 50 years. This is a very long time for any disease to establish and when doctors finally do diagnose the health issues of the patient as mesothelioma, unfortunately it has spread to an advanced stage.

My question I have, that was not answered by any of my research is:

Why not go to your doctor before the symptoms begin, and you are still in the latency period. Talk to them, inform the doctor you worked with asbestos and what can they do to stop mesothelioma from taking your life?

Another factor in the mesotheliom survival rate of the asbestos exposed is the stage it is in when they are diagnosed.

Stage 1 and 2 have a better rate of survival because the disease has been caught early.

Stage 3 and 4 have a lower survival rate due to the advanced cancer growth and fewer treatment options available. Treating a cancer that has spread to other organs is an almost impossible battle to win inside the human body.

So, to recap, we have learned here that our mesothelioma survival rate goes up with the earlier diagnosing of it. I say, go to your doctor if you work with, or have worked with or around asbestos products. Learn the symptoms, educate yourself, this will help you in the end.

Other factors in the survival rate are:

· Age of the patient when diagnosed

· Does the patient smoke

· Health of the patient at diagnosis

· Size of tumor and if it has spread or can be removed

Treatments can improve Mesothelioma Survival Rates among some patients. Some of these treatments being rather aggressive such as surgery, chemotherapy, radiation help some people. Remember though this varies from person to person. For some these therapies help, for others it does not.

Some survivors have had success with alternative therapies which aim to strengthen the immune system and boost their well-being. Some of these therapies are acupuncture, massage, yoga, nutritional supplements.

Mesothelioma Survival Rates are not good and that is a sad fact. However we can increase the time we have with out loved ones who have this dreaded disease and more time is always a good thing.

I am sorry that I need to reveal to you the very low Mesothelioma Survival Rate, if it is any consolation, I have been in your shoes of having a loved one diagnosed with this disease.
It makes me hate the material of Asbestos and the destruction Asbestos Poisoning does to the body and our loved ones. I know the hate for a fiber is not healthy and does me no good and I will not hold onto it.

Only a Mesothelioma Lawsuit Can Bring in Good Compensation

People suffering from mesothelioma need to spend a huge amount for their treatment. This disease of mesothelium, known as mesothelioma, usually is caused due to prolong exposure to dust and asbestos. So, this disease is more common to the workers who work in stone-crusher industry or asbestos company. The effect is not seen immediately subsequent to working in those places, but prolong years of working gradually trigger the disease of mesothelium. It directly affects the heart and lungs. So, this disease particularly is very painful to those getting affected by the mesothelioma. To get compensation for such painful suffering, taking recourse to mesothelioma lawsuit with the help of mesothelioma lawyers is the only option. For this the victim or anyone who is a keen to the victim or someone with legal interest to the victim can go for mesothelioma lawsuit. Though lawsuit is not always the only available option but always the first step towards the compensation. It depends on the skill of the lawyers to decide whether to continue with the litigation or taking resort to arbitration accomplishing ultimate aim, which ends in successful claim of compensation sometimes amounting to hundreds of dollars or even sometimes, unbelievably, is million of dollars.

There is another interesting part in the mesothelioma lawsuit, the victim or anyone legally entitled to seek redress, usually, does not need to pay a penny at the first instance to the mesothelioma lawyers. These lawyers work in no win- no fees basis. So, when the mesothelioma lawsuit is filed then there is no need to pay any fees to the mesothelioma lawyers. If the case is won, only then the lawyer will take a percentage from the awarded compensation as fees for the lawsuit. Finding a mesothelioma lawyers requires a bit of research through available resources. The best option is to find a mesothelioma victim who has won in recent past such lawsuit. Only this kind of patient having first hand experience can provide the true information about mesothelioma lawyers. Yet, it is neither always easy nor possible to find such a patient in near neighborhood. So, in that case the only reliable option left is researching through internet. Point to be kept in mind when trying hard to find mesothelioma lawyers, is how many such lawsuit has been successfully won by them. How much compensation their clients got awarded or how much time is required for successful completion of the case. It is not an issue of concern for the victim as to where the jurisdiction of the lawsuit will lie. The lawyer would decide the jurisdiction as to in which state the availability of the compensation would be easy to find. In different states the mesothelioma lawsuit may bring in different amount of compensation and time for disposal. So, it is always better to leave the decision regarding jurisdiction in the hand of lawyers, as they are experienced in this field and obviously will opt for winning the case for being awarded the compensation, as their fees depend on it.

Mesothelioma - Ayurvedic Herbal Treatment

Mesothelioma is a rare form of cancer which develops from the protective lining that covers the internal organs of the body such as the lungs, the abdominal cavity and the heart. Environmental or occupational exposure to asbestos is mainly believed to be the cause for this condition. The commonest presentation of malignant mesothelioma is in the pleura which covers the lungs. Common symptoms include breathlessness, chest pain, collection of fluid in the pleura, and general symptoms such as weight loss. Diagnosis of this condition is usually done with the help of chest x-ray, CT scan of the chest and biopsy of the pleura. Signs and symptoms of mesothelioma appear nearly 20 to 50 years after exposure to asbestos. The cancer can spread to other parts of the body and produce different local symptoms. The modern management of this condition involves surgery, chemotherapy, and radiation, or a combination of these treatment modalities; however, the overall results are quite poor even with combined treatment. Survival after a confirmed diagnosis of this condition is an average of 1 to 2 years. Exposure to asbestos can have medico-legal implications and this condition is usually associated with lawsuits, seeking compensation for the condition.

Ayurvedic herbal treatment for mesothelioma is aimed at treating the tumour, preventing its spread to other parts of the body, and improving the overall survival rate. Ayurvedic herbal treatment can also be combined with modern management such as surgery, chemotherapy, and radiation therapy. Because of the aggressive nature of mesothelioma, Ayurvedic herbal treatment needs to be instituted at the earliest possible. Ayurvedic herbal medicines are required to be given in high doses and for prolonged periods in order to control this condition. Since the commonest presentations of this disease is in the pleura covering the lungs, herbal medicines which have a specific affinity for the lungs and the pleura are used as the mainstay of treatment in the management of this condition. In addition, herbal medicines which have a specific action on the blood tissue are also used in the management of mesothelioma. Medicines are also used to prevent the spread of this condition through the blood and lymphatic circulation. The medicines which are most useful in the management of this condition have an anti-inflammatory effect as well as an anti-cancer effect. The use of such medicines therefore helps in controlling inflammation, infection, as well as actually killing and removing the cancer cells.

In addition to the above treatment, Ayurvedic herbal immunomodulatory agents are also used in high doses in order to boost the immune system of the affected individual so as to help fight against the cancer and bring about a complete remission of the condition at the earliest. A strong immune system also helps to maintain the strength of the affected in individual and brings on a feeling of vigor and vitality. Depending upon the presentation of the disease, symptomatic treatment is also given for symptoms such as chest infection, fever, hemoptysis, pneumothorax, and the formation of pus in the pleural fluid. Herbal medicines also need to be given to flush the dead cancer cells, toxins, and debris generated in the treatment either through the gastrointestinal system or through the kidneys. Medicines useful in the treatment of Mesothelioma include Kantakari (Solanum indicum), Manjishtha (Rubia cordifolia), Saariva (Hemidesmus indicus), Guduchi (Tinospora cordifolia), Gokshur (Tribulus terrestris), Amalaki (Emblica officinalis ), Kanchnar Guggulu, and Mahamanjishthadi Qadha.

Most individuals affected with mesothelioma require aggressive Ayurvedic herbal treatment for about 12 to 15 months in order to comprehensively control the condition and significantly improve the survival rate. Ayurvedic herbal treatment thus has a significant contribution to play in the management and treatment of mesothelioma.

Mesothelioma Lawyers

Mesothelioma was a recent addition to the family of malignant cancers. The origins of the disease lay in certain asbestos-related industries especially asbestos-mining industry. Additionally, there were shipyards, insulation factories and construction companies where the workers were, unintentionally, exposed to asbestos dust and fibers that made their way into various organs of their bodies through the process of breathing. Having once entered into the human body, the asbestos dust managed to stay there for decades before revealing its presence in form of symptoms. These symptoms confused the doctors as they were related to the commonly prevalent diseases like pneumonia. Obviously, the prescribed treatment proved to be of no avail and the symptoms worsened as more treatment was prescribed. It was after the origins of the malady were traced to real culprit, i.e., the asbestos dust in the asbestos-based factories that the legal community woke up to its responsibility with regard to its victims.

Since the actual number of victims is not very large, the litigation demand is not substantial. As such. the supply in the form of lawyers specializing in Mesothelioma cases is limited.

If you are one of the unfortunate victims of mesothelioma, you will have to put in some effort to search out the right lawyer for your lawsuit for compensation. Lawyers truly specializing in Mesothelioma-related compensation cases are not easily available in every nook and corner of your counties and cities. The best course would be to find out from your colleagues or those who have suffered by working in asbestos-based industries and who may have also filed a lawsuit for compensation. Their experience with respect to the capability of the lawyer and the quality of his services can be invaluable.

If you search the Internet, you can find the websites of forums, social organizations, lawyers and law firms dealing exclusively with the causes of the sufferers of mesothelioma. A contact with them can be of great help and can save you many a false step in a trial-and-error approach and expensive mistakes.
